Scam

I leased a car from Fucillo Kia only to find out after I signed all the paper work that there was no interest rate on my contract, after calling kia motor finance they told me how much I was paying in interest and I nearly fainted.....my credit score is in the very high 700's and I am paying 16.9%.....what the *** is that. Also they did not tell me that the car did not come with a spare tire or jack....I found that out when I had a flat tire!

I wanted to turn the car in and OMG...the fees were ridiculous and none of these fees are on the contract! So instead I decided to sell the car, I called Kia motor finance ( whom financed the car) for a pay off. I was told I owed $10,800 but I was also told that I had to pay it off at the dealer which made no sense to me at all, being as I pay my monthly payments to Kia motor finance, not the dealer, so I went to Fucillo kia to pay it off and I had a cashiers check made out for the exact payoff. I get there and the finance manager tells me that that is not the correct payoff because he needs to add taxes and document fees and that they also do not accept anything other than cash for a payoff!

BIG RED FLAG....the taxes are as with any other car purchase included in the price that you finance! He came back saying the document fees are $595 and the taxes are $1058.....since when is 6% of $10,800...,,$1058!!

Needless to say I threw a HUGE fit and I have contacted the attorney general, fox 4 in your corner and the BBB. I want all the interest back that I have paid, since threre is nothing on my contract about any interest rate and I want them to get into to trouble for trying to double tax people.....they are nothing but scammers!!!

He has scammed in New York too, look him up on google. Billy Fuccillo New York scam an read that article.

when you leased your car your tax was based on the payment, not the selling price. Kia or any other manufacturer doesn't have a retail sales lic so you would have to purchase the car through a dealer that sells Kia, but it wouldn't have to be Fucillo.

Guest

You can sue them. It's illegal to not list or document rate of interest. You could argue that it's zero interest

Page 2's last comment refers to lawsuit in Upstate NY against Fucillo, here's full story-Incidentally I believe he came to Florida initially to thaw out; found this is area with a lot of older f retired folks whom he could scam or pull Bait & switch tactics on like me, promising to get me financed b then never does.

SYRACUSE, N.Y.

- Billy Fuccillo's auto business and 18 of its New York state dealerships agreed to pay $1.6 million to settle a class-action lawsuit that claimed the dealerships sold car buyers an over-priced and illegal theft-protection package years ago.

Some 5,320 car buyers who bought the $295 theft-protection package from Fuccillo dealerships - including Fuccillo Hyundai of Syracuse -- are entitled to payments of $160 each, according to a settlement approved in November by U.S. District Judge Lawrence Kahn in Albany.

The class-action lawsuit covered consumers who bought cars between 2003 and 2012, but Fuccillo dealerships stopped selling the "Auto Theft Security Discount" package in 2007, according to court papers filed by company lawyers.

The lead plaintiff, car buyer Heidi Seekamp, of the Albany area, was awarded $10,000 from the settlement. The plaintiffs' attorneys will get $750,000, Kahn ruled last month.

Fuccillo's company, It's Huge Inc., did not admit any wrongdoing as part of the settlement. The company and the 18 Fuccillo dealerships named in the lawsuit agreed not to market the Auto Theft Security Discount anymore.

The litigation attorney for Fuccillo's company referred questions to another company lawyer, who did not respond to a request for comment Wednesday. Seekamp, who bought a 2007 Hyundai Elantra from a Fuccillo dealership in Schenectady, filed the lawsuit in January 2009. Seekamp's car came with the $295 theft-protection package, which included two components: The car's vehicle identification number was etched into the window; and Seekamp was entitled to a 10 percent discount toward the purchase of a new car, or $2,000, if the Elantra was stolen and not recovered. Seekamp's class-action suit claimed that the theft-protection package was an illegal insurance policy, because it was administered by a company that was not a licensed insurer, Universal Automotive Services, of New Jersey.

The lawsuit also claimed that the theft-deterrent value of the service was exaggerated and over-priced, because the cost of etching the VIN into the window was only $20 to $50. New cars by law already have VINs installed in 18 locations on the vehicle, according to the lawsuit. According to court papers, the Auto Theft Security Discount was sold to roughly 16,200 customers, who were notified in August about the settlement.

Of those, 5,320 submitted claim forms by the Oct. 31 deadline and will be paid, court records show

I agree 100%. The guy is so *** annoying.

Wish he would shut up. He waste all his money on *** advertising. If he wanted to make it worth people's while, give them a chance to win 2 cars at the 3 point line.

Ridiculous to say the least to give away 1 car at half a court. What's he afraid of.

Poor service

I'm not a happy customer right now, when you deal with sales people on the phone and they tell you we won't turn you away that's bull *** because guess what they turned my boyfriend away who has a bmw too trade in and makes 5000. A month and credit score almost in the 600 they are a bunch of lieing people, and they don't stick by their word they just figure ( sales people) on what your payment will be when they don't even talk too a higher up manager. I have sent so many people in their in they did the same thing too them. If you want too help the people who are trying too build up their credit and help the community like billy says he wants too do then why did you just turn my boyfriend away? I WILL NOT send another person their! I'm so discussed on how we were treated.....now we will take our business some where else

i'm sorry, i just have to respond to the last few "reviews". Credit score of ALMOST....600!!!

Priceless! Not one reviewer had proper grammar, let alone being able to spell! I love "i got home and looked at my paperwork and saw the interest rate!". Smart people can deal with this dealership.

Not for cruises, cash back or a swish! I am ready to do business with this dealership BECAUSE i am not dumb. And no, KiA is a fabulous vehicle contrary to one ***.

I'm coming to see you Billy! I dont want the cruise, just a car!

Almost 600 is sub prime credit. BMW means nothing if there is still negative equity on it.

Year, mileage, appearance ... If it was well worn and used, even a BMW can be termed as a dollar car.

Bully doesn't have final say, the Bank does. Billy can only plead your case but if your debt to Income ratio is tanked, you're at the mercy of your own poor financial decisions.

Did the same to me. My complaint is that he didn't even give me a spare tire, jack, and tire iron when I bought a new Soul.

Of course, he didn't tell me this. I had a flat tire a year later, and had nothing to fix it.

But he can give away cheap flatscreen TVs to attract new customers. Billy Fuccillo is a piece of ***; this is also the name of my Facebook page.

My elderly parents were taken advantage of, Big Time.

My 81 yr old parents were tricked into buying a car.

My dad, who has dementia from a terminal cancer made a discussion which he is not capable of making.

My mom kept saying no, but the sale people kept saying oh, your husband said yes.

My dad cant even afford his cancer medicine, let along an new car.

These people at Fuccillo are EVIL and should be put out of business for taking advantage of the elderly.

Please pass this on to whomever you know.

FUCCILLO KIA CAPE CORAL SCAM MEN!

FUCCILLO KIA CAPE CORAL ARE FULL OF SCAMS WITH WORTHLESS CARS. Bought a used Sorento from Fuccillo Kia in Cape Coral FL with low miles and had to take it back to Fuccillo Kia a day later.

It began making noise. I waited and they looked at it and found nothing wrong. It began making more noise so i had another mechanic look at it and the mechanic says the engine needs work.

Why the heck didn't you say this when I bought the car!

You are scam men just out to make a buck and you SUCK!

Furthermore, all those Google reviews are Fake and Fictional Reviews, all obviously written by the dealership! They probably bought fake Google profiles.

Here's the truth -- Cape Coral Kia will sell big on a ride then stuff the contract with bulls*** fees that you were never aware of and don't need. They sell *** cars!

Can you read? Why didn't you see all the extra fees you speak of when you SIGNED the contract?

no ones fault but your own. Also, used cars are sold as is unless with a specific warranty.

It's up to the buyer (that would be you) to have the used car checked out by an independent mechanic at a fee of around 150. Money well spent but apparently you didn't want to invest.

Guest
reply icon Replying to comment of Guest-962797

Typical of the average car buyer. They find out things AFTER the sale.

Contracts can be READ. Independent inspections could be done. Why people do not READ their contracts (especially the lines where the money is listed) and WHY you would buy a used car with no factory warranty OR buy an extended warranty OR get an independent inspection done is amazing on its face. True independent inspectors do NOT work for a shop OR neither do they sell any repair services.

This is done to avoid a conflict of interest. In any event, if you don't do your due diligence then don't get on these sites and complain that it is the dealerships fault. Personally, I do not know about the integrity of this dealership. I spent over 20 years in the retail car business.

FIRST, there is no FREE money. They are putting the $1000 in the deal if it is there. If not then they will tell you they need to use the $1000 as a down payment. Second, these "FREE cruises" are not anywhere CLOSE to FREE.

There are things that the customer has to pay to get their "FREE" cruise so they aren't free.

THIRD, DO YOUR DUE DILIGENCE!!! If you do not check out everything BEFORE you sign and take delivery then don't cry once you find out the deal is not what you thought it was.

This website explains most of it.

The owner (We are told) is genuinely a good guy. But when he is visiting his other dealerships, his crooked employees take advantage of his absence and rip customers as much as they can get by with.

Kia Motors shows absolutely no concern of what this dealer or any others do. When speaking with them it was made clear their dealers have free reign. Whether it's false advertisements fake contest or false promises to close a sale.

So, stay away from not only this dealership but ANY Kia dealer.

Even the sales manager straight out told me he backs his salesman's tactics even when they lie. He said it is the salesman's prerogative!

May 9, 2013

I hope you take the time to read this entire letter or at least forward it to someone who will.

We do not want to take legal action against the dealership. Even though numerous people have said we need to. Our issues are about being lied to by the salesmen, being lied to by the finance dept., being mis-treated by the general manager and given a big run around from the office manager.

Our plight began last August, Fuccillo Kia in Cape Coral, FL was having another one of their “HUGE” contest. This one was a catered dinner with Mr. Fuccillo himself for everyone that purchased a car in the month of August. Plus they were having drawings to pay off some cars and $1,000 cash for others.

We went to Fuccillo on August 25th, 2012 just to check it out. Our first warning sign should have been walking all through the inventory and finally going near the front door where a group of 6 or 7 salesman are sitting around, talking and we guess they were on break. My wife had to actually interrupt someone to get their attention to ask for help looking at some vehicles. Two of the guys pushed Robert Enrico in front of them and told us it was his turn. My wife specifically wanted a Kia Soul in “Alien Green”. He said they did not have any new Souls at all. The 2 we saw were reserved for a giveaway the next week. But they did have one used 2012 in stock. He assured us the warranty was no different than if we purchased new. So we took it for a test drive. There was a small dent and some paint damage on the passenger fender. He said the car had just arrived and they had not had a chance to fix that yet, but would get it taken care of if we purchased that one. We also asked about some thick gobs of silicone above each of the four doors and several other knocks and scratches all around the car. He said they would take care of all of that.

We went inside and started the negotiation process. Robert had a gentleman go look at the scratches, chips and the dent. I do apologize, I have his name but can not seem to find it in my notes. He was wearing a black polo, whereas the salesmen wear red polo’s. He is a tall thin man with black hair.

Anyway, he said he would not fix the small stuff, it was after all a used car. But the dent and paint damage on the fender was something they could do. Just not today. We were fine with that. Robert (salesman) then repeated that we would get a full tank of fuel and a full detail before taking the car.

He also asked us if we knew about the August contest, we said we knew something about a dinner with owner. He said “Yes, but they are also paying off 10 cars, and knowing Billy he will pay off 20…plus they are giving away $1,000 cash to a lot of customers that get their names drawn”

We left for lunch to talk it over. We called back, made an offer, Robert said he would call us right back. He did and we made a deal. When we arrived at the dealership he said he wanted us to take the car home. They were closing early (this was a Saturday) and would not re-open until Tuesday. They were in hurricane prep mode due to a storm that was forecast to come thru our region. (Luckily it passed us by).

When we did the credit application we requested to only go thru our credit union. We were definitely against multiple credit inquiries and did not want to look at Kia or other banks. Robert assured us this would not be an issue. He said he told the finance person and it was not a problem.

Tuesday, August 28th, Robert called to let us know we had been approved through Kia Financial. My wife asked why they had ran our credit thru them and he said finance told him they were 9 percent lower than our credit union. Which did not make any sense to us since our Honda, which we bought used, is only 6.4% thru our credit union.

So my wife accepted it, and we just figured we would move the loan over to our credit union in a couple of months. He asked if we could wait a day since someone was out sick and finance dept. was short handed. Plus they needed income verification for my wife. She printed it out that same day.

Wednesday the 29th Robert called again and asked if we could wait until Thursday night. We were ok. with that. Then Thursday afternoon he once again asked if we could wait. He said finance dept. was still short handed with someone out sick. Then on Thursday he once again called to put us off until Friday. We informed him Friday would not work, we had an event at our sons school to attend. So we decided on Saturday the 31st. The last day of the contest.

Robert called us Friday the 30th and asked if we could wait until after Tuesday. He said they had something big going on at the dealership on Saturday and he would not be able to help us. We asked about the August contest, and he told us not to worry. We would still get in since we had credit taken care of and it was their fault we had not finished the paperwork yet. Plus we still had the car in our possession. So we took his word and waited. We found out the next day it was some huge party for their customers and we would have loved to have attended. And the dinner with Mr. Fuccillo and the drawings were held the very next day.

So when we confronted Robert about this on Monday, he said he was aware, but wanted to save us for the special September contest. He said it was much bigger than August and we will be glad we waited. At this point we should have driven the 40 mile trip to Fuccillo. Handed them back their keys and walked away. But Robert just kept building up this special contest to my wife. Told us he could not give details yet, but we would know in a couple of days. On Sept. 6th, when we finally were able to get in with the finance persons schedule we went to Fuccillo. Only our 2nd visit ever to the dealership. I make a point with this because they gave the Better Business Bureau false information and dates of our visits to the dealership. We live over 40 miles away, we did not make extra trips there. When we made small talk with the finance person and said we felt bad with him being so backed up and stressed last week. He had no idea what we were talking about. So we did not say anything more.

After signing the final paperwork, during which time our car was supposedly getting cleaned and fueled up, we asked Robert about making an appointment to get the fender damage repaired.

He then said that he had been told they sold the car too cheap and would not be able to fix it. But he would talk to his boss and get it taken care of. Then we asked about the contest, He said he still didn’t have details, but is was really big.

We went outside to get the car, it was late and it was dark at this point. So we did not pay attention to the detail job yet, but as soon as I started the car I noticed it did not have much more fuel in it than it did when we arrived. Barely under half of a tank. My wife got out of the car and got Robert’s attention (they had locked the showroom doors behind us when we walked out to the car).

He saw the fuel gauge and said, “Oh yeah, they just told me we do not fill up used cars” But he promised to talk to his boss in the morning and call us right away. The next day, in the sunlight, it was obvious the car had not been cleaned. Plus the gobs of silicone were still above all the doors. And there were greasy hand prints on the silver part of the interior door.

Well, that was the very last we ever heard from Robert. He never called, he never returned our calls, he was never available when we called him.

We managed to get an email to Xavier Villarreal (General Manager). He actually called, over a month after the sale. He started the conversation by asking me how I had managed to get his email address. I told him we had received an automated form letter with a 10% off of service coupon and I had simply replied to that address. This seemed to upset him. Then he asked what was the problem, I told him everything Robert had promised. He said that I should know better than to believe a car salesman. He made me feel like an ***. He down talked me. He said he backs up his salesmen telling customers what they need to as long as it sales a car. I honestly was shocked at some of what he was saying. I have sold cars, boats, motorcycles and RV’s. I have never met a general manager, a sales manager or a finance manager that would admit something like that to a customer. Yes, I am aware there are some who do feel that way. But they are rare and they are the crooks that give most dealerships a bad rep. He then proceeded to say, “I know how you feel, everyday you have to see that thing sitting in your driveway, you are bitter about the situation, you regret coming here”, I agreed somewhat. And then he said, ”Oh well, there is nothing I can do about it, I knew before I even called you that there was not going to be anything I am willing to do, it is your car now” I wrote all of this down immediately after getting off the phone with him. He then offered to wash the car, but nothing else. He said he wanted to look over our deal (apparently he did not look at it before calling us) and would call me back that afternoon.

That was on October. Since then I have sent a written letter, multiple emails and left voice messages. Absolutely zero contact from him or the salesman.

When we contacted our Credit Union to find out why they wanted 9 percent more than Kia. They looked it up and they were within ½ of a percentage point of Kia. They explained that the dealerships get kick backs form certain banks and most likely Kia was the most profitable for them.

We recently had the car detailed ourselves and when the gobs of silicone were removed we discovered why Fuccillo did not want to remove them. Above each door is *** that has been drilled into the roof of the car. They are rusty. Apparently something had been attached to it at some point? So I had to put silicone back on them because they will allow water into the headliner when it rains.

Our latest issue involves our Gap coverage. I checked with our insurance company, we are not in any danger of being upside down on the loan balance if something happened to the car. So we contacted the GAP insurance carrier. They said we need to contact the finance dept. at the purchasing dealership.

We initially called on March 24th, 2013. No one was available so we left a voicemail. Called back on the 25th. Over the next week either me or my wife attempted to contact the finance dept. at Fuccillo but could not get a call back. The my wife called and asked for the General Manager, the person on the phone asked if they could tell him why, she told them, They put her on hold an all of a sudden someone from finance was able to talk to her. They then told her that it was not something they could take care of and that she needed to speak with Brittany. So we took turns calling for a couple days and finally someone said she was on vacation for 2 weeks. We expressed our concern with cancelling the GAP since it was prorated by time. We were told that would not be a problem, that we would simply date it for March 24th when we first called to cancel. So after Brittany returned we started taking turns calling her and leaving voicemails and leaving messages with a real person. No return call for 10 days. Then my wife called and once again asked for the General Manager. When the receptionist asked what it pertained to, she told her. Suddenly Brittney was available. She told my wife the cancellation papers would be sent out in the morning. And affirmed that we could back date the cancellation. A few days later we still had not received the paperwork. We called again, now we are told there is not a Brittney working there. It took a couple of calls to find out that she was no longer working there. But there had been a Brittney. The person replacing her would call us and get the papers out. Now we were back to calling and leaving daily messages for 4 days, Then we were out through to the Office Manager. She said the papers would be sent out right away. We finally received them yesterday.

May 31, 2103 UPDATE: We filled out the form, made a copy and mailed it back/ 2 weeks later they claim they never received it. They asked us to fax it, we did, they claim they never got that either. The office manager then asked us to scan and email it. We did. Still nothing! This whole fiasco is stuff you think you would read about but never experience!!

We have made numerous attempts to get action from Kia Motors. But they tell us they have nothing to do with the dealers. They are franchises and completely on their own to do as they will. We have had nothing but stellar treatment from Suncoast Kia in Venice where we have taken the car multiple times (going back again next week) for warranty issues. They did tell us the salesman lied about the warranty. It is now 5/50 not 10/100 since we bought it used.

We have make a conscious effort to tell co-workers, neighbors and anyone we meet to stay away from Kia and Hyundai. I have looked for every general website and consumer site and auto review site and letter to the editors that I can find. I have been posting negative reviews and sharing our horrible experience from Kia and Fuccillo wherever I can. Sad part is much of this could have been avoided if the salesman had simply called the day after delivery. I have been told by people who know Billy Fuccillo personally, that he would definitely take care of us. But I have not been able to find a way to contact him or to get a letter directly to him.

My next step is to get this letter to someone in Korea if need be.

Dude, typical car dealer ***...these clowns have a slowly worsening rep around here. (started out good) But not much worse than other shifty dealers (which is about 95% or more of them)

Have known a couple of people at work that regret dealing with the *** that does all those *** commercials. Apparently the sales manager is a real ***

Quite a few of us came to Florida happy we would not have to deal with that "Huge" ***. Well, here he comes following us.

The Fuccillo bunch has a horrible rep back home (New York). They have been in lots of legal battles for this same B.S.

Write it off as a lesson learned. And yes, MOST salesmen lie.

And the "Huge" Kia place is just as full of liars as the dirtiest side street used car lot.

Just more money to spread around and buy peoples opinion.

Ronnie S Dwx

It's a car dealer...what did you expect?

They are all equally crooked...some may lie more than others

..but that's how they make their money...check out web info on Mr. "Huge" in New York.

There's reasons he had to come to Florida for those *** commercials.

Got busted for false advertising.

Fuccillo Kia of Cape Coral - Fraud, Scams & Liars

Keep driving past Fuccillo Kia of Cape Coral Florida or you might get a *** deal. Sure, its challenging to buy a car from any dealer these days, but Fuccillo Kia will certainly fill your contract with add-on fees that you shouldn't be paying.

They try and cover up the negative reviews by placing their own reviews all over the web but if you keep reading, you'll see tons of people have stated the same problems with Cape Coral Kia. Here's your warning - - go to another dealer or look over the contract line by line and ask questions or google it before signing.

the service can be slow, but stop by on a Saturday and you'll see why! ABSOLUTELY PACKED!

Fuccillo must be doing something right if they are able to pack the entire dealership every week.

if you want second class service, a shoddy deal go to another dealership. I shop Fuccillo, because its HUGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGE

all of these negative comments are such rubbish! Look at the people leaving this comment and a majority of them leave horrible reviews for Fuccillo but then go to other dealerships to leave stellar!!

Tell me this isn't fishy!

try out the dealership your self before you believe everything you read online. Bought my soul here and loved it.

I have lease a car from Fuccillo when they first opened and today my husband had purchased a new car. We were treated really good.

I go there for my oil changes and recalls if any and employees have been nothing but professional.

The people who are giving them negative comments probably wanted something for nothing. I am so glad they are here.

Feeling screwed in northern New york . So returning car tommorow.

And Sarah, I thank you for your illiterate comment. Thought contract was full of surprising and unnecessary fees. And found it fishy myself. However, sarah on the dealers side.

Sarah, you write many run on sentences through out. Oh, and you bought your sold there.

Lol...darling you sold your soul there. What a joke!

Fuccillo Cape Coral Kia Florida filled with Scammers

Fuccillo Cape Coral Kia dealership on Pine Island Road, will overprice the car you're trying to buy and insert erroneous fees into the contract. Every step of the way, Cape Coral Kia in Cape Coral Florida will tack on more money. Just when you think you've got a good deal, Bam! There are additional fees, quick-talking salesmen and let me not forget..."hold on and let me see what my manager says." LOL, please. They play the oldest tricks and if you're not careful you'll end up with a l-o-n-g contract filled with nonsense fees that you are needlessly paying. If you stop at Cape Coral Kia - RUN - do not go inside, cover your eyes, stuff your ears cause what you're seeing is not the truth and you're only hearing a bunch of ***

Not Impressed with Cape Coral Kia

Went to Fuccillo Kia with my cousin and was not impressed. They do have plenty of cars but the hard sell turns my stomach. The salesman did not want to reduce the price at all and I checked on my phone -- the car was overpriced. I think they are so hyped about their own service that they don't know there are other dealers. Walk away and check with other dealers before getting sold on a vehicle thats overpriced. And, read the reviews online. The BBB has negative items, Yelp and a host of other sites all have negative reviews about Fuccillo Cape Coral Kia

No Way -No How at Scam-Man Fuccillo Cape Coral Kia

Went there yesterday to look around...buying a new car this weekend and wanted to check out a few dealers. The one thing I hate about every dealer is the chase as soon as you walk onto the lot. You don't get a chance to look before they hunt you down. So, I asked a few questions and there is no way I would chance a deal at Fuccillo Cape Coral Kia. They first ask how much you want to spend, then how much you have for down payment, then trade...Its all rehearsed. There may be favorable reviews about them but its really doubtful when you hear them upclose and in your face.

Did it occur to you they wanted to make sure you were looking at cars you can afford rather than being disappointed..

Why look at a $600 a month car when you can only afford $300.

That's not a complaint you wrote it was a note showing your ignorence and exactly why they asked you those questions.
